4th Amendment Rights, Do They Still Exist????

I recently had the displeasure of being paid a visit by the local sheriffs department. I also recently wrote a letter to the editor of our local newspaper about this visit to try and see what the general public’s reaction to this ordeal may be. Below please read the Letter-To-The-Editor that was published in The Hampshire County Review on Wednesday June 20 2012.

On Thursday, April 12, 2012, I was in my home hanging drywall with the assistance of a hired worker. Suddenly, two men wearing Hampshire County Sheriff Deputy uniforms appeared in my open doorway. One man asked if my name was David Hill and I replied that my name was David Hill, Sr. He then stated that he had two capiases for a David Hill. I immediately informed the apparent deputy that the capiases were probably issued for my 22 year old son, not me. I also informed him that my son was not in my house and had not lived at my home for more than six months.
Disregarding my statements, the deputy entered my house without invitation, drew and pointed a Taser gun at me, and demanded that I turnaround and put my hands behind my back. He cuffed me and forcibly removed me from my house while my hired worker stared in amazement and disbelief.
Suffering from a longtime shoulder injury, I immediately experienced severe cramps in my right shoulder because I was cuffed with my hands behind my back. I pleaded for the deputy to remove the cuffs and the deputy disrespectfully replied, “Shut Up”. After a minute or two, I again pleaded with him to move the cuffs to the front but to no avail.
The second deputy then entered my house and forced my hired worker against the wall, searched him, and demanded identification. At no point during this entire ordeal did I or my worker show any sign of aggression or resistance; but I did request legal justification for the unjust intrusion of my person and property.
Any alert, astute law enforcement official should have realized the capiases were defective on their face – no physical description, age, or identifying information of the person to be apprehended. I am 55, over 250 pounds, and graying hair. My son is 22, 165 pounds, and brown hair. After the deputies called dispatch to obtain additional description, I was released by the deputies but no apology for their wrongful attempt to arrest and detain.
Do the citizens of Hampshire County have a reasonable right to privacy and security in their own home as guaranteed by the 4th Amendment? Apparently not if the Hampshire County Sheriff Deputies who have sworn to uphold the law act on obviously defective capiases as occurred in this case.

Trust me when I tell you that this is a very edited down version of the whole story due to being limited to 400 words or less if you want your story published. I will gladly write the whole story if enough interest is shown in the comment section. This whole ordeal could have been easily avoided had the Deputy Sheriffs that were involved in this chosen the course of deescalating the scenario instead of escalating it into something it never should have became. In my opinion they had the intent to arrest someone right or wrong and would stop at nothing short of that. I would be very interested in others opinions on this so please leave your comments . I would also be very interested in speaking directly with anyone that has legal knowledge on what they think would be the best course of action to insure that no one else has to endure the pain and humiliation that I have endured over this ordeal.

Have we already lost all of our Constitutional rights in this country?
Should law enforcement agencies have the right to enter your house and detain you without complete information of who they are looking for?
It is my belief that if left unchecked by ordinary law abiding citizens like myself, issues like this one will become the norm not the exception to the rule.
The word of incidents like this must be made public and hopefully thru the use of the internet stories like this will be shared every place that everyone has the ability to re post them. Please feel free to re publish this story, put up links to this story, report this story in your youtube videos, etc etc etc….Please help this story go viral on the internet. Only thru public outcry can we ever have a chance to put a stop to law enforcement running wild and doing whatever they want to do regardless of our protection from them under our constitutional rights.

When I sent this story to the editor of the local paper it also went to the Governor of the state of West Virginia, The local elected Sheriff of Hampshire County,The State Attorney Generals office, and all of our elected representatives. There has not to date been a single reply to me by anyone. I fully understand no elected official wants any problems during an election year but I fully expect all of them to have concerns when it comes to protecting my constitutional rights.

I know this is no Rodney King story but abuse of our Constitutional Rights of any kind by the very agencies that are sworn to protect and serve the citizens they are employed by must stop. Period!!!!

    I hear your story, but unfortunately your not the only one to have experienced this from law enforcement. Just a few weeks ago police forcibly endtered the WRONG home with out any warning encounters the home owner holding a gun (ready to defend himself against what he thought was robbers) when the police shot him dead. Mind you, the police never warned the occupants of this dwelling that they were police prior to breaking the froint door down..

    Our Constitutional right don’t exist anymore. Police do as they wish even to the point of FALSELY arresting and prosecuting individual on FALSE evidence. We now read about people being arrested for distributing RAW MILK or growing a garden in their yards. The law enforcement community is just as out of control as our government is. And it about to get a lot worse.

    A lot of people look at this as “as long as it’s not me, I could care less” until it does happen to them , then we all hear “how could this be happening… My friend, it’s OUR fault this is happening, we keep re-electing the jerks that have caused this problem. WHEN WILL WE EVER LEARN???????

    heres another mishap. about 25 years ago i had fell from a horse in a show ring. had 2 compresion fractores. my youngest daughter had a very bad heart. i was finally up and walking after 8 months of bed rest and decided to take her in our green pinto to see my mom and dad about 60 miles away. i had a brace on my back
    it so happend the police was looking for thr briley brothers who had shot and killed some guards and other people and escaped to nc. they beat a older man and his wife in nc and tied them up and took their green pinto and headed up rt 100 in va. some state police started tailing me in a white plain car. then passed me and looked us over then met with another state officer
    i had stopped in a gas station at rt 100 and interstate 81. the state police pulled up about 50 ft away pulled his gun and was shaking very much and told me to get out of car and also my passenger. i ask him what was going on. he said get out and tell your passenger to get out. i explained i had to get out slow because of a broken back . he was very nervious and his hand continued to shake. he said i saw you reach for a gun. i had none with me
    i told him i had to help my self out of the car.
    my daughter was crying. i ask him to let me pull up my shirt and show him the brace.
    he started to scream at me to stand still. i told him to calm down we hadent done anything. he said the briley brothers had escaped and beat a older man and wife and took their car. (a green pinto) soon a lot of police cars and people was all around us. the captian said be careful down the road we will put out a call you are not the briley brothers. i said yes i know my daughter is a long black haired girl with bad heart and we both are white . the briley bros are black men.
    the daughter had to have a heart transplant and lived till 3 years ago this 0ct 2012

    maybe the state trooper was wearing dark glasses

    First as to your question as to weather we have lost our constitutional rights? I could give you the one word answer but you already know don’t you?
    Had a similiar situation , in reverse. I was dispatching and a deputy on a traffic stop called in for wants and warrents on his traffic suspect. Yep there was a hit on the Name and the deputies immediately hitched the kid up. the kid was protesting , his father was protesting. Finally the Deputy asked dispatch for a reconfirmation of the warrent and a compleate read out of the hard copy warrent ( Took about an Hr. to get the hard copy.) when it was read back to the arresting deputy you could almost hear him swallow. The kid was 21 6’2″ 180 lb blond hair . The warrent (same name) was for a guy 5’8″ 160lb brown hair 43 yrs old. Oppps. I have no idea how the conversation went between the Sherriff and the representing attorney or how much it cost the county. Now my question for you my friend, Have you seen an attorney yet??? 73′s
    PS , if this ever happens again , ask them to double cuff you , it will give you a little more room for the bum shoulder.

    Dave sorry to hear about the incident, I never heard of a capiases in Pennsylvania is it something like an arrest warrant? It is a shame police or sheriff deputies are not properly trained. Have you talked to a lawyer of some kind about a lawsuit.
    In Pa. Sheriffs Deputies don’t usually have that sort of power. I would call the State Police before I surrendered to Deputies. There have been to many home invasions in our area and a lot of home owners are armed even while at home. I hate to see and hear when they handcuff someone behind their back. I also find it offensive that they want everyone to get on the ground, no wonder people get mad at them. I had a judge tell me one time that if I wanted justice in his court – how much justice could I afford to pay for, he also told that to my friend that who happened to get stopped by the same speed trap.
    My son was the scape goat and involved with the county court system.
    They have all the power to come down on you, but how much money do you have to hire the best lawyers to defend your self or a loved one.
    Our justice system in this country is not fair. He who has the most money seems to usually win.
    We can pray or be prepared to go down fighting

    Well my friend, that just sucks. I know that I sometimes have a strange view on the world, but as I see it you only have two choices. The best one is to talk to an out of county attorney You do not want a local one as they all have to work together and will not want to upset the apple cart with folks they have to work with day in and day out. The second option, in my weird world, is to track them down individually and beat the ever loving hell out of them one at a time with no witnesses around. I’ve been told by some of my cop friends that this is generally what has to happen to turn an over zealous cop into a decent one. Don’t let them get away with this as too many folks just brush this nonsense off and that’s why they act like this, because they are not held accountable for their actions.

    Thank you for the comments….To answer the questions individually would take to much time so I will try in one comment…

    I have not yet contacted a lawyer and to be honest all I really wanted originally was a formal apology.

    They did use 2 sets of cuffs but that was not any help in my case… My right shoulder can not take being put behind my back at all. I even requested the deputy to hook them thru the push bumper on the front of his car but he replied by telling me to SHUT THE F#@$ UP.

    After realizing there mistake and removing the cuffs they then set me down outside, not allowing me back in my own house and yelled at me for being so stupid for well over a half hour. I guess that was there twisted way of saying we are sorry.

    The capiases are best explained as a bench warrant issued for failure to appear. So far my understanding of this is that it does give them the right to enter your house to execute them but only if they have a positive ID of the person they are after. That was impossible in this case because the only info on the papers was the name David Hill and my mailing address. There was no full name, no date of birth, no social security number, and no physical description of any kind for the person they were looking for.

    The icing on the cake with this is that the one issued from West Virginia was all over a traffic violation not anything serious or involving a violent act of any kind. Yet these officers acted like they were after a serial killer or something.

    Please file a formal written complaint against both officers detailing these events. We must have these instances on permanent record of the offending officers to show trends. One of the reasons this type of behavior continues is because police officers feel that there are no repercussions to their actions. Formal complaints on their record will show a patter of behavior and give them pause in the future. This is something all citizens need to do to keep a record of actions by police officers.

    This is an event that happens daily. What surprises me is how the people continue to lay praise on there own enslavement by putting cops on a pedestal.

    You constantly hear – “They work for us & To Protect & to Serve” – Well guess what, They DO NOT work for us and they never have, The Cops work for The Corporation that Hires them IE Your City – That is who they are Protecting and Serving.

    While the Sheriff is elected buy the people and is supposed to protect us from crimes and corruption — they don’t anymore and also serve the State.

    Both the Police and the Sheriff’s are now Federalized by Federal Funding and grants – They are both out of control and very militant towards any “Civilian”.

    Many keep saying that there are good cops – well i will respect them when they start to turn in the corrupt – Until that point they have no respect from me and many i know.

    The “Good” cops still follow any order at your expense/demise for a pay check.

    This is indeed the norm. Somewhere in your conversation, if you can get one, will be “officer safety”, which if boiled down tells you they are more concerned about themselves than the public. The subject NEEDS to spread widely, as you have only become aware of this AFTER your experience. This is very common. Always ask AM I UNDER ARREST, and state I DO NOT CONSENT TO SEARCHES. This will establish with your witness or their video that they have arrested you and then your rights are better defended.
    The game they will then want to play is called see who can answer a question first;
    1) the opening gambit goes like this. WHAT are you hiding, or not wanting us to see, or afraid we’ll find? ..some variation thereof.
    2) the proper response (most hated but expected is) what are you looking for? This question and answer game then goes into a circle.
    to break out you repeat am I under arrest..then am I free to go.
    Note; another variation of their response will be “we can get a warrant..” … the correct is is yes you can and on it you wil list what your looking for. anyway it a fun adventure if its your first time.. it gets easier with practice. I have done it MANY times from the Law enforcement side and since from our side.
    If you are told you are under arrest the the ONLY answer is do I have the right to remain silent. (only real answer is yes) and SHUT UP. totally completely except to say I need to chat with my lawyer before proceeding. Watch what those magic words do.. it all changes.
    this is the common overreach into the private lives of us “civilians”
    as for your worker.. you are never required to produce ID in your own home unless they state a probable cause. (and they never want to, it limits and confines them)
